Re: February 15, 2008 13th Check payyment for fiscal year ending 9/30/2004

Dear Pensioner:

The Tampa Fire & Police Pension Board is pleased to announce the principal amount of the 13th check benefit for fiscal year ending 9/30/2004. This 13th check will be in the amount of $5,700 for eligible retirees (retired or in DROP on or before 10/1/2003) and $2,850 for eligible surviving spouses. This 13th check will be dated February 15, 2008—a separate transaction from your regular February monthly pension benefit. The 13th check amount is the same for all retirees regardless of years of service, age, years retired, or monthly installments. Eligible surviving spouses receive one half of that received by retirees.

If your entire monthly pension check is direct deposited, then your entire 13th check will be direct deposited. If any portion of your monthly pension check is mailed to you, then your entire 13th check will be mailed to you. For anyone subject to tax withholding from your regular pension check, the same tax withholding type (i.e. M02, S00 or set W4P dollar amount) will apply to this check. No other deductions will be withheld from your 13th check.

Payment of this 13th check has been made possible only through extensive research and due diligence. The Board requested a thorough de novo review by Board Counsel Ron Cohen and Co-counsel Patrick Gonyea. As a result, on 12/13/2007 the Board of Trustees decided that this 13th check should be paid even if there is still a make-up of investment losses to the base, as long as all other conditions are met, including certification from the fund’s actuary. On 1/24/2008 the Board received and adopted the necessary certification.

The issues of interest and/or attorney fees are currently under litigation and will be discussed in separate correspondence. We thank you for your patience and understanding while the Board of Trustees has worked through this difficult and time-consuming process.
