This was a two-part hearing. The first part was the fairness hearing. The only objector was Fred Pena's attorney because he was worried it would affect their lawsuit against the pension fund. After Parker's attorney and the pension attorneys agreed that the Pena case had nothing to do with the Parker case, they agreed to add that language to the settlement documents. Pena's attorney withdrew his objections and the judge approved the Parker settlement as previously agreed by both parties.
The second issue was the amount of attorney fees. Parker's side finished with their witnesses and each was cross-examined by the pension attorneys. The pension attorneys brought up their first witness, but time ran out before he could be cross-examined by Parker's attorney. Unfortunately, he was scheduled to be out of town starting the next day, so the hearing was continued until September 29th at 1:45 PM. If there is more time needed, it will be continued until September 30th at 1:45 PM. Replies: There have been no replies.
