I was of the understanding that we did not receive a 13th check in 2004 even though there were positive gains to trigger a 13th check because the fund had cumulative actuarial losses and the Parker lawsuit addressed this issue. What is different this time? Can someone give us a better explanation as to the difference between 2004 and now.
