I received the email below from retired District Chief Fred Urbuteit. It is the latest Urinating Contest that is taking place at The F&P Pension Fund. If you are not up to date on these public document request read from the bottom up.

Thanks for your response to my E-Mail.
Hopefully you have not yet implemented your plan to not read or open any of my E-Mails , as I have a few items to make you aware of which might be helpful in your understanding the Government in Sunshine Law!
1. The Law can be researched on the following site : www.myflsunshine.com/sun.nsf/pages/Municipal

2. In my opinion you are dead wrong on this matter of violation of Sunshine Law:
(a), I am not a member of the government, nor am I acting on behalf of one , therefore the Sunshine Law does not apply to me.
( b ). Trustee Lynch,s E-Mail to Ms. Campbell was a public document as soon as he sent it( see the disclaimer on the bottom of all Pension Board E-Mails ) . Sharing that document with anyone would not be a violation of the Sunshine Law, even if it was sent to a governmental official ( which of course we can all agree I am not ).
( c ).As far as I know Trustee Lynch did not copy any other Trustee, and for him to provide his opinion without intent of a response would not be a violation of the Sunshine Law. See Attorney General Opinion 2001-21 which deals with this issue directly.
( d ). I welcome your intent to bring this matter up at F&P Pension Board Meeting for a " full public disclosure".
( e ). Lastly, I have in past Board meetings expressed that there is a feeling among many Beneficaries of the F&P Pension Fund, a "lack of transparency" emitted to them from the Board , whether intended or just an unintended aura that is omitted , it is there. Your reaction to me of not reading or opening any E-Mail from me , is a good example of that lack of transparency as well as ,in my opinion , your lack of knowledge or erroneous interpretation of the Florida in Sunshine Law!

I hope this intended cutting off of E-Mail communication, from me , is not intended to draw me into a , and I will quote our Plan Administrators un lady like and unprofessional comment in open session ,at the Board Meeting in September ,2011, I Quote " draw me into a urinating contest " , end quote, between your self and another Trustee!

I would hope we can continue to agree to disagree and still be cordial to each other!

If by chance Chairman Gray does not read or open this E- Mail , I would solicit any one who is in contact with him to provide it to him, with my permission !

Thanks to this E-Mail I recieved below , it appears that some of the Trustee's are listening to the Benificuaries concerns and trying to take measures to correct any cost to us in inspecting Public Records!
If this comes up at a Board meeting, to change Board Policy 818-Public Records , I am sure there will be STRONG objections raised by at least the Plan Administrator!

Why would we need to charge inspection time? We have a security guard, receptionist and recorded surveillance system that should be able to monitor someone flipping through an RFP response.

This doesn't appear to be a judicious interpretation of Policy 818 - Public Records. I believe if we were challenged on it in court, we would lose.

I know that we just reaffirmed the policy, but we may wish to revisit it to protect the board/fund from unintended consequences.

I would be very appreciative if you would furnish me , for my inspection, the RFP for General Board Council Legal Services presented to the Board by Mr. Ron Cohen , when he saught the position for F&P Plan attorney.
Please respond via E-Mail when these Public Information Documents will be available for my inspection.
I wish to view these documents so as to help me in my learning process of our Pension Plans procedures.
