I received the following from Retiree Ribaya, pertaining to my email about the Pension Board meeting.

He is absolutely correct Trustee's Fox, Bogush were present at that meeting as well as the 2 Trustee,s ( PJ Gray and Rich Griner ) involved in the telephonic voting . None of these Trustees mentioned the possible Sunshine Law violation, as did any Trustee. I guess there will be another Policy/Procedure for the Plan Attorney to come up with.

Just for clarification, in reference to your email dated 22 November 2013, it has been over 6 years since a firefighter was elected as chairman. Also, Chairman R. Griner, Trustee S. Fox, Trustee M. Bogush and Trustee PJ Gray were all present at the 19 November 2009 Trustees' meeting when Pension Attorney R. Cohen shared his opinion on voting telephonically. Cohen said it was a Sunshine issue and Ms. Campbell said it needed to be posted at least 24 hours in advance of the meeting date. While I'm not sure it is a Sunshine violation, maybe someone will address this issue at the December meeting and the Trustees will decide once and for all how to handle this issue.
