Greyhound owners ask state to reconsider dog racing decision

TALLAHASSEE — A group of greyhound owners and trainers asked state regulators Tuesday to reconsider a first-of-its-kind decision that would allow a Miami pari-mutuel facility to end dog racing while continuing to offer lucrative slot machines.

The Florida Greyhound Association filed a motion seeking to formally intervene in the issue and requesting that the state Division of Pari-Mutuel Wagering reconsider the decision last month in favor of West Flagler Associates, which operates Magic City Casino.

The decision would allow the Miami facility to replace dog races with jai alai matches and continue operating slots. The approval dealt with a long-controversial issue known as a "summer jai alai" permit. In the motion Tuesday, the Florida Greyhound Association said doing away with dog racing at the track, formerly known as the West Flagler Kennel Club, would put members of the association "out of business."

It also disputed that state law backs the decision by the Division of Pari-Mutuel Wagering, which is part of the Department of Business and Professional Regulation.

"There appears to be no showing that the petitioner (West Flagler) meets the statutory qualifications to convert their permit to summer jai alai — let alone convert their permit and continue to operate slot machines," the association's attorney, former Lt. Gov. Jeff Kottkamp, wrote in the motion.
