I think you're probably just out of luck.
You could report the seller to eBay and, at least, have the listing removed. He is in violation of their policy regarding selling of property for which they to not have ownership rights. In the USA, you would be considered the intellectual property owner - no formal filing is required. Perhaps, the same in Spain.
In order to take legal action, you would need to show that you had been 'damaged' by his actions. For example, if you were already marketing this item, and he started selling counterfeits, you would have a case. But, if the financial impact was small, it wouldn't matter anyway.
I think your only reasonable recourse is the "Naughty, naughty!" route via eBay.
Or, you could buy one of them ... then post negative feedback to spoil his 100% rating ... lol
