DFRDB UPDATE – December 2018
1
This will be just a short update to advise that, after more research, we now have a
different view of DFRDB concerns.
Herb has developed a new case and submitted it to the Attorney General, with a copy
to the Shadow Attorney General (see copy of email below).
This new evidence may come as a shock, particularly to those who campaigned at
length for fair indexation. But the evidence, confirming that DFRDB retirement pay
and invalidity pay have never been fully indexed, is irrefutable.
We believe our new case will hold up in Court and will put that to the test by
submitting complaints to the Commonwealth Ombudsman and the Superannuation
Complaints Tribunal.
We encourage you to view the new DFRDB Case but warn that it runs for 34 minutes
and 50 seconds and is not directed at the layperson.
Please bring it to the attention of your local member and your state’s Senators.
We wish you the Season’s greetings and a safe and Happy New Year.
Jim and Herb

Subject: The Case for the Amendment of DFRDB Act 1973 and the Restoration of Unindexed Benefits
Dear Mister Attorney General,
On numerous occasions, recipient members of the Defence Force Retirement and
Death Benefits (DFRDB) scheme have approached the Minister for Defence
Personnel, The Hon. Darren Chester MP and his predecessors, to seek;
a. Amendments for the removal of unjust provisions in Defence Force
Retirement and Death Benefits Act 1973 (DFRDB Act) and
b. The restoration of benefits reduced as a result of those provisions.
The Minister and his predecessors have consistently rejected those approaches.
This audio-visual presentation includes new evidence which proves beyond doubt
that my fellow DFRDB recipients and I are the victims of discrimination.
Please consider this evidence and the initiation of action, to restore unindexed
DFRDB benefits and the amendment the DFRDB Act, as requested.
Yours faithfully,
