If true, it's yet another example of how ass-backwards and broken our laws can be.
In this case they would be rewarding / incentivising a shit level of performance by management.
The original provisions gave casino licenses preferentially to existing parimutuels with the idea that they could use some of the income to bolster their preexisting business. However, there were no rules that required them to do so, and instead the game changed to "We have to drop the parimutuel side because it's dragging us down."
So the more they sabotage or neglect the parimutuels, the stronger their apparent case that they must get rid of them.
I'm not going to write an essay here, but if I were involved in the initial legislation, there would have been a need to prove annually that some extra effort had been put into jai-alai promotion in order to maintain the casino license. Futile or not, no exceptions allowed, at least for a trial period of several years.
