You need to stop looking at it from the business or live POV and look at it from the STATE perspective. Ok, so live losses are tax write offs. The state receives 40 bucks a game from jai alai and zero on attendance and handle. They lose on oversight. So, you now want the state, who's sole goal is TAX REVENUE to FORCE the company to increase WRITE OFFS by spending on something that will never make money WHILE risking the owners just saying F#&#/ IT and closing the doors costing the state licence renewal fees and ALL tax revenues from poker or whatever casino ops they have? Not. Gonna. Happen. Poker is taxed like mad and slots are almost predatorily taxed at in excess of 25 percent. So, your logic is seriously flawed from a business and regulatory aspect altogether.
