Let's talk about this for a second. You all wanted real life discussion - well here we go. Read this from the Radio Insight story on Afentra's suit:

The judge also denied Entercom’s request for summary judgment as to the Equal Pay Act claim stating, “Generally, a system measuring quantity or quality of output refers to “a bona fide incentive system,” such as an equal dollar per unit compensation rate or commission program. Although “[t]here is no discrimination when one employee produces more and is therefore compensated more,” a pay differential is not justified where “women had to produce more work in order to be paid the same as men. First, in arguing that Plaintiff’s pay was based on a system measuring quality or quantity of output, Defendant cites to no real system. Instead, Defendant cites its Operations Manager’s amorphous explanation of what he considers in determining salaries and argues that Plaintiff’s performance issues cost Defendant $1,000,000 and hindered her ratings and ability to drive revenue. These arguments fail to provide the Court with a basis to determine that Plaintiff and Dare’s pay differential was based on a bona fide incentive system.”

He follows, “But Defendant’s evidence points only to the criteria used in determining Plaintiff’s pay. It says nothing of the criteria used to set Dare’s pay. Without evidence of a system applied equally to Plaintiff and Dare, Defendant fails to meet its burden with respect to this affirmative defense.”


OK real talk. This is exposing the system all jocks have lived under since the Clear Channel era. We were expected to do more with less. VPs of Programming expected us to succeed and win, even while the pay was disparate. No one has been making Dare money in the last 20 years. As I pointed out there are a few up in the stratosphere now, but that's after 20 years of work.

I'll be watching this closely and have to give it to Afentra. She has a point. Up until this time we all blindly accepted that this was the way it was. We were spoon fed this bull that Johnny had started in the 90's and that his history of huge ratings and big success justified the large pay. Plus it was the face that his "pay" actually was pay for the entire show. That's one big point in Entercom's favor. He wasn't pocketing 750k.

So what happened while we all accepted that Johnny was the only one worthy of pay? His rating slipped. People making 50, 60k passed him by. But we never challenged our companies. We were lucky to have jobs, we were told. Johnny became the NFL player who got a huge contract based on past performance but couldn't keep up on the field. And yet we never asked for his type of money. We'd have been laughed out of the the room and then fired. Many of us beat Johnny at times or another. Or beat up on other well paying morning shows. The question is now, can I go back and sue my employer for under paying me?

This case is interesting and could have far-reaching consequences across the country. We'll be watching.
