2004-13th. Check Settlement

To All Retirees,
I have provided our Webmaster with the most recent documents re the settlement of the 2004-13th Check. As you know, we have posted the amounts of the AGREED TO AMOUNTS. Generally, the amounts are $1,500.00 for eligible retirees and $750.00 for eligible surviving spouses. The DROP recipients will get higher payouts because they have a contractural agreement that pays them the amount the fund actually made. In regards to the documents the Webmaster is posting, be advised of the following. THE DOCUMENTS BEING POSTED ARE FROM ATTORNEY WAYNE THOMAS AND HAVE NOT BEEN AGREED TO BY OUR TRUSTEES OR OUR ATTORNEYS. After the pension board meeting on Thursday, Oct. 15, there will be an executive session. The Trustees will meet with our attorneys and decide on how to respond to Atty. Thomas' proposed "Motion TO Amend The Class." After the executive session, the pension board meeting will be reconvened to discuss the decisions made during the executive session. Any appropriate motions will be made at that time and a vote taken. I will be there for the whole time and will report to all on what actions were taken, if any. I will post the actions by 9 pm tomorrow night. All Retirees should know that the pension board attorneys have offered Atty. Thomas the sum of $250 thousand dollars to settle his fees and costs. As I have said, in our October Newsletter, that is pretty good pay for taking a case that was handed to him by Atty. Jim Loper. I do believe that both Atty. Thomas and Atty. Loper have committed violations of the Florida Bars ethics. I do not understand why this isn't being pursued through a complaint. I would like all to know that I will probably receive a complaint from Atty. Loper and possibably Atty. Thomas for my opinions of their colusive actions in this matter. I did receive a written threat from Atty. Jim Loper approx. 2 years ago about saying that he was wrong when he said we weren't entitled to the 2004-13th Check. The threat was sent to my home by Certified Mail and was from Atty. Jim Loper. The letter advised me to cease and desist in my belief that we were owed a 13th. Check. As history has borne out, Atty. Loper was wrong and I was right. Our new pension attorney, Ron Cohen, agreed with me and the applicable Laws and advised the Trustees that the 13th. check should be paid. There you have it.
