The Board of Trustees voted today, 8 September 2011, to take the John Parker Class Action Lawsuit to the 2nd District Court of Appeals to appeal Judge Richard A. Nielsen’s decision. As you recall in my last letter Judge Richard A. Nielsen ruled that the Pension Fund owed Attorney Wayne Thomas $1,026,610 in fees plus 6% interest and $33,567.56 in taxable court costs.
The attorney for Travelers Insurance, Patrick Gonyea, was the leading voice for the appeal since Travelers Insurance Company is on the hook to pay Attorney Wayne Thomas' fees.

So it’s off to the 2nd DCA and as stated in my last letter, not a surprise. As retirees we are well aware that this appeal process will take about 12 to 18 months, to get settled. Look for more legal fees to be spent on this exercise in futility.

How many more retirees will pass on without ever receiving what is rightfully theirs?
