I would respectfully disagree, the opt-outs and the those who decided to jump in on the lawsuit band wagon are not "equal". As an opt-out I was willing to accept nothing rather than being a participant in a lawsuit I knew would only serve as a win fall for the lead plaintiff and his attorney, at the expense of our pension and its members. The opt ins have enabled this law suit to keep growing like a cancer on our pension fund allowing the lead plaintiff and his attorney to keep ringing their cash registers. With every appeal their win fall rolls over like the lottery. All the while telling the opt-ins that they are fighting for you. When it is all said and done the millions of dollars the opt-ins are going to cost the pension fund will be another negative liability to the fund. I say do not reward the opt-ins. They were the catalyst that got them to where they are today so make them finish what they started. When it is all said and done they may be paying their attorney everything they were entitled to but at least they will have the satisfaction of suing the pension fund.
