More on Pension Possible cover up

Received the E-Mail below from retiree Ribaya.

It appears there is Policies & Proceedures to cover the following mistake.( My E-Mail below )

By the way this mistake was made after Bob Klausner was hired as the Plan Attorney, at $300.00 an hour.

You would think the Plan Attorney would be aware of these policies and advise the Board of Trustees to cease paying out the Pension Funds money.

Did past Board Chairman Rich Griner forget about the Policies & Proceedures when he was in office? This happened when he was Board Chairman.

The Board of Trustees needs to correct this mistake as soon as possible.

After reading your latest email, Possible Cover Up at Pension Board, I did some perusing and found the paragraph below in F&P policy 432. Policy 432 addresses pensions of any person granted a pension if found to be erroneous.

Also see policy 415 below.

Paragraph in policy 432: The Board is empowered to purge the pension rolls of any person granted a pension if found to be erroneous, fraudulent or illegal for any reason and to reclassify any pensioner who has been erroneously, improperly or illegally classified.



Policy 415: If a Plan members pension is miscalculated and the member is required to reimburse the Pension Fund for an overpayment, the Board of Trustees shall allow the amount owed to be repaid in six (6) month installments. These arrangements shall be made in order to avoid causing a hardship on a member who has to repay monies to the Fund.

While listening to the Pension Board recording, the discussion on the firing of F/F Nelson jumped out at me.



F/F Nelson is grieving his firing and at the same time receiving a Pension, which is not Legal. He has received $106.347.00 in Pension ( so far and growing each month ) which he should not have. Who is going to pay for this mistake; TAXPAYERS, Past Plan Administrator Jennifer Campbell, Pension Fund or F/F Nelson ?



The plan attorney stated that he called the union President and was told that a former pension employee gave F/F Nelson advice to file a grievance, the Plan attorney insinuated that " the Former Director " should not have given this advice. I took this to mean the former Plan Administrator Jennifer Campbell.

After this discussion a question was asked if there were any safe guards put in place to prevent this from happening in the future. The Plan Administrator Tiffany Earnst stated that this was not known by the Staff at that time and that now that it is known a Policy should be put in place to cover this- it was restated by Plan Administrator Tiffany Earnst that Staff was not aware of this incident.



In all fairness to past Administrator Jennifer Campbell, I feel this is hearsay and I did not hear the Plan Attorney say whether he asked the Past Administrator Jennifer Campbell whether this is fact or not and I did not hear whether the BOARD CHAIRMAN in office at that time ( Police Trustee Rich Griner ) was asked what his knowledge of this incident was.



Could this be a cover up on past Chairman Griners part ?



Without a recording NO ONE would have known about this . Another reason for recording the meetings.
