The text of the Second Amendment:
A well regulated Militia, being necessary to the security of a free State, the right of the people to bear Arms shall not be infringed.
There’s talk that Biden is about to issue an executive order limiting access to “assault rifles.” It’s about time he did and let SCOTUS decide whether the Constitution has rights in the liberal assault against this amendment. Gun rights advocates can then sue the U.S. Government about such illegality, citing two defenses, both containing meaningful words of the amendment’s dependent clause:
1. The words “A well regulated Militia” refers directly to military type arms, which means “assault rifles” inter alia, and
2. The phrase “...a free State...” means that individual States—not the United States—have exclusive responsibility, and the Federal Government has no say in the matter.
C’mon, man. Issue your damned executive order and let’s go behind the gym in the Courts.
