Like it or not, one of the factors (and its a heavily weighted factor) that must be considered by an arbitrator in their decision is the ability of the employer to pay. Lots of luck fighting the city on this one - they don't even have to make up a fake story about being broke, they are broke! Furthermore, five personnel on a company is going to be looked at with a skeptical eye by any arbitrator when the city presents evidence at the hearing that many large urban departments don't run with 5 and that 75% of CFD responses are EMS-based. So for all those counting on an arbitrator to help Local 2, don't hold your breath.
