Who can make the request? IP: 72.64.227.31 Posted on December 19, 2008 at 08:43:27 PM by Jerry Wotherspoon
I think the point here was that Bud was asking the Pension Board to take the initiative and draft a request to Tallahassee, without consulting with their Attorney, to review both the Boards and the Attorneys past actions in reference to...well the letter speaks for itself.
The facts are the Pension Board would not draft a letter of that magnitude without first consulting with their Attorney and the Attorney wouldn't recommend it because it would be in essence a request made by the Pension Boards asking Tallahassee to review all actions by the Pension Board and the Attorney in reference to potential contract violations. I'm sure the Pension Board Attorney must feel that no contract violations have occurred.
I understand why the Pension Board will not make the request through their Attorney, because it would generate more Attorney fees and the Attorney is telling them it isn't necessary because there have been no contract violations.
The question is, could a Board Member draft a letter on their own? The answer is, Yes. Would any of them? I doubt it. And from what I heard the letter must come from a Board Member.
