Wow, what a mess. I am also not an attorney nor am I knowledgeable in legal and pension matters. Seems to me though that if J.J. is right, what was that payment to op-outs really? A reward for opting out? Paid from a fund that actives have a vested interested in? Wouldn't that be a violation of fiduciary duty. If paid from the general fund, gains on that money to opt-outs would belong to actives too. If the attorney fees are to come from the "Common Fund" and some of that money was already paid to opt outs, then what? Will opt-outs have to refund some of that money?
I also agree with Chief Urbuteit and Dennis Tea.
