I am also not an attorney and I am only expressing my opinion. The monies that were distributed to the opt outs was NOT money from the COMMON FUND.... It was monies from the BASE FUND distributed by the board to the opt outs, at their discretion. This was done due to the fact that the COMMON FUND monies had to be available to pay Mr. Thomas should the 2nd DCA rule in favor of the board. In actuality the monies in the common fund are those of all the parties, opt ins and opt outs, and as such everyones money, opt ins and opt outs is still available to pay Mr. Thomas.
